Yes. Fertilizer manufacturers, importers, and retailers all need licenses to sell fertilizer in the United States.

Is there a governing body for fertilizer?

There’s no federal governing body for fertilizer, but there is one organization that works to keep state regulations relatively standard. 

The Association of American Plant Food Control Officials (AAPFCO) is an independent group of state regulatory officials that promote uniform legislation for the regulation of fertilizers across the U.S.

What is the TSCA Inventory?

Even though fertilizer isn’t federally regulated, there’s still one federal act to be aware of: the EPA’s Toxic Substances Control Act (TSCA). 

Fertilizers have to list their chemical makeup in TSCA Inventory. That lets the EPA give their stamp of approval that your product doesn’t contain any heavy metals or chemical compounds in dangerous amounts.

What are amending materials?

Depending on the makeup of your product and the claims you make about it, your product might qualify as an amending material or soil amendment instead of a fertilizer.

Amending materials are products that don’t provide nutrition to plants, but have some other benefit to soil like: 

  • Aeration 
  • Drainage 
  • Permeability 
  • pH regulation 
  • Water retention
