Do you need a license to sell seed?

Yes. Seed manufacturers, importers, and retailers all need licenses to sell seed in the United States.

Getting a license to sell seed involves working with each of the 50 U.S. states and submitting a ton of paperwork. You have to remember to renew your license every few years and submit tonnage reporting with every state, too.

Is seed federally regulated?

Seed is jointly regulated at the federal and state levels.

The USDA’s Federal Seed Act (FSA) sets federal regulations for seed labeling.

At the state level, each state’s Department of Agriculture dictates what type of seed products can be brought to market in that state, and is ultimately responsible for testing and regulating seed products.

What is the Federal Seed Act (FSA)?

The USDA’s Federal Seed Act (FSA) is a truth-in-labeling law that regulates seed shipped in interstate commerce.

The intent of the FSA is to make it easier for consumers to compare seed products that originate from different states. In short, it helps shoppers compare apples to apples — or any other type of seed, for that matter!

Is there a governing body for seed compliance?

There’s no true governing body for seed, but the Federal Seed Act is enforced by the USDA Agricultural Marketing Service, specifically their Seed Regulatory and Testing Division (SRTD).

SRTD collaborates with state agencies to promote uniformity among state feed laws. They also offer a handful of seed testing services to make sure that the information on your product’s label is accurate.

What information is required on seed labels?

It depends on the type of seed, but in general the Federal Seed Act requires the following information to be present on any seed label: 

  • Seed purity percentage
  • Germination percentage 
  • Number of noxious weed seeds per pound 
  • Chemical seed treatment (if present) 
  • Kind and varietal identification 
  • Name and address of the interstate shipper

What about seed packets?

Seed packet labels are regulated, too. States require the following information on seed packets, among other details: 

  • Common name of the seed 
  • Lot number or other identifier 
  • Origin of the seed 
  • Germination percentage and test date 
  • Pure seed percentage and other seed details 
  • Name and address of the labeler 
  • Seed variation requests
